"The two key points of Print Reserve is that the works MUST be supplementary readings - e.g. they must not be compulsory reading that students will be tested on or that are integral to the course and they must be composed of less than 25% of required reading pages. I know it is a bit complicated but this is the set of guidelines that AUCC has produced for us and the university lawyer has decided we must use those guidelines.
It does not sound as if this is the case in the scenario you outline.
If material does meet those two criteria, then yes, the material can be put on Reserve and the students are allowed to make a copy for their individual study under the fair dealing exception. It may seem like semantics but the court case we have in Canada makes it very clear that if instructor initiated, it would not be considered fair dealing (as they are essentially asking for multiple copies) If it is supplementary to the course, then the student has the option of requesting it and then making a personal copy and therefore it is considered to meet the fair dealing exception.
They are allowed to post their slides on BB or Osler if the material in their slides includes only very small portions of a work - e.g. a figure or a chart from a couple of sources, properly cited. We are saying that they must assess risk - to use a link to the figure if at all possible but if not, to use only a small portion of a copyright work which is most likely not commercially available -say an art slide or slides which can be purchased as a set."
